1. Company, Website & Service Identity

Qurban Africa is operated by FAKT Impex Inc. (Registration No. LL18894), Labuan, Malaysia. References to “Qurban Africa,” “we,” “us,” “our,” or “the Company” mean FAKT Impex Inc. and its authorized operational teams, partners, agents, suppliers, and field representatives engaged for service fulfilment.

Our services may include Annual Qurbani / Udhiyah, Aqiqah, Sadaqah Sacrifice, Nazar / Votive Sacrifice, Zakat-related giving, donation campaigns, proof uploads, certificates, invoices and customer dashboard access, depending on what is enabled on the website at the time of your order.

2. Wakalah / Agency Appointment

By placing an order, you appoint FAKT Impex Inc. as your Wakil / agent to procure, allocate, arrange, supervise, slaughter where applicable, distribute, document and report the selected service on your behalf. The exact scope depends on the service you select at checkout.

Once a sacrifice has been completed in accordance with the selected service and operational requirements, the service is considered fulfilled and cannot be reversed.

3. Religious Guidance & User Responsibility

Website content is provided for general guidance and is not a fatwa. Qurbani, Aqiqah, Sadaqah, Nazar and Zakat obligations can vary by madhhab, country, circumstances, intention and scholar. You are responsible for consulting your local Imam, Sheikh, Mufti, qualified scholar or trusted Ulema if you require a religious ruling for your personal circumstances.

We aim to follow recognized Islamic requirements for eligible animals, humane handling, recitation of Allah's name, appropriate timing and distribution. Final acceptance of any act of worship remains with Allah (SWT).

4. Service Selection & Order Accuracy

• You must select the correct service / intention before adding a product to cart.
• Your selected service, nominated name, donor/payer information, contact details and order notes must be accurate.
• We are not responsible for errors caused by incorrect names, incorrect service selection, duplicate orders, wrong phone/email, or incomplete instructions submitted by the customer.
• Name corrections should be requested as soon as possible. We will try to assist, but corrections may not be possible after operational allocation, scheduling or sacrifice.

5. Animal Specifications, Shares & Substitution

Animal descriptions, weights and family-feeding estimates are approximate. Livestock are living beings; exact breed, colour, horn shape, size and final weight may vary. We aim to source animals that meet applicable Shariah eligibility and health requirements.

• A sheep or goat normally represents one share/person.
• A cow/bull/buffalo may be divided into up to seven shares where applicable.
• If a selected animal type becomes unavailable due to local supply, disease control, transport limits, seasonal pricing, weather, or other field conditions, we may substitute with an animal/service of equal or better value to fulfil the religious purpose.

6. Timing, Scheduling & Distribution

Annual Qurbani / Udhiyah is performed during the permitted Eid al-Adha days according to the relevant local timing and operational schedule. Aqiqah, Sadaqah and Nazar services may be scheduled year-round depending on livestock availability, payment confirmation and field logistics.

Unless explicitly stated otherwise, meat is distributed locally to eligible families, poor communities, or beneficiaries selected by our ground team and partners. International delivery of meat to the customer is not part of the service.

7. Proof, Certificate & Invoice

We aim to provide appropriate proof such as photos, videos, certificates and/or invoices depending on the selected service, available field connectivity and the customer's preferences. Proof material is evidence of service execution and transparency; it is not a condition of religious validity where the sacrifice was properly completed.

• Proof may be individual or batch/field-level depending on operational conditions.
• Rural internet, weather, device failure, slaughterhouse restrictions, privacy needs and field safety can delay or limit proof.
• Certificates and invoices may be generated after payment and/or completion confirmation.
• Proof files are for the customer's personal use and may not be misused, resold, edited deceptively, or used to impersonate Qurban Africa.

8. Prices, Currency, Payments & Third-Party Gateways

Prices may be shown in USD or another enabled currency. Prices may change before payment due to market movement, livestock supply and currency fluctuations. Once an order is paid and accepted, the price for that order is normally locked unless a clear pricing or system error occurred.

• Payment may be made through enabled gateways such as Stripe, ToyyibPay, PayPal, manual bank transfer or other methods shown at checkout.
• We do not store full card details. Card and bank details are processed by the relevant payment provider.
• Third-party gateway fees, bank charges, international transaction fees, currency conversion fees and declined-payment decisions are controlled by the provider or bank, not Qurban Africa.
• Manual payment orders are not treated as paid until our team verifies the submitted proof and payment receipt.

9. Account Creation, Communications & Notifications

Guest checkout may create or link a Qurban Africa account after order submission and/or payment confirmation. Access details, order confirmations and service updates may be sent by email, WhatsApp, SMS, dashboard notification or other contact channels you provide.

If your email address already exists, you may be asked to log in or reset your password rather than creating a duplicate account.

10. Cancellation & Refunds

Cancellations and refunds are governed by our Cancellation & Refund Policy. Because livestock procurement and field scheduling are time-sensitive, cancellation rights reduce after allocation, procurement, scheduling or completion. Approved refunds may exclude payment gateway, bank, transfer and currency fees that are not returned by third-party processors.

11. Prohibited Use, Fraud & Chargebacks

• You must not use stolen cards, false identities, fake payment proof, forged documents or misleading order details.
• You must not use Qurban Africa branding, certificates, proof videos, company details or partner details to impersonate us or solicit funds without written permission.
• If a chargeback is raised without first contacting us, we may provide order records, proof, payment logs and communication records to the payment provider or bank.

12. Force Majeure & Operational Risk

We are not liable for delay or failure caused by events beyond reasonable control, including severe weather, drought, flood, disease outbreaks, government restrictions, border closures, political instability, civil unrest, internet outages, payment gateway downtime, transport breakdown, livestock supply disruption or other force majeure events.

13. Limitation of Liability

To the fullest extent permitted by law, FAKT Impex Inc. is not liable for indirect, incidental, consequential or special losses, including loss of profit, loss of opportunity, emotional distress, reputational harm, payment provider decisions, or losses caused by incorrect customer information. Our maximum liability for a paid order is limited to the amount received by us for that specific order, subject to these Terms and our refund policy.

14. Changes to Website, Services & Terms

We may update products, pricing, countries, service availability, proof methods, policies, website features and these Terms from time to time. The version displayed on the website at the time of use applies unless a specific written agreement states otherwise.

15. Governing Law & Contact
